Terms and Conditions

TERMS & CONDITIONS

Virtually Fortified Alcohol & Drug Offender Education Inc.

Effective Date: September 12, 2026

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE REGISTERING OR MAKING PAYMENT.

By registering, making payment, electronically signing or acknowledging these Terms, or submitting enrollment documentation, the participant acknowledges that they have read, understood, and agreed to these Terms and Conditions and the applicable Class Expectations.

These Terms apply to all programs and services provided by Virtually Fortified Alcohol & Drug Offender Education Inc. (“Virtually Fortified,” “VFADOE,” “we,” “our,” or “us”), except where different requirements are imposed by applicable law or the Texas Department of Licensing and Regulation (“TDLR”).

1. PARTICIPANT RESPONSIBILITY

The participant is responsible for selecting the correct course and confirming that the course satisfies the requirements imposed by the participant’s court, judge, probation officer, community supervision department, attorney, DPS, employer, licensing agency, or other referring authority.

VFADOE cannot guarantee that a particular course will satisfy an individual’s specific legal, licensing, employment, or supervision requirements.

Participants must provide complete and accurate information during registration.

Providing false, misleading, materially incomplete, or inaccurate information may result in delayed enrollment, denial of admission, removal from class, termination of enrollment, or withholding of a certificate when permitted or required by applicable law.

2. PAYMENT RESERVES A LIMITED CLASS SEAT

Payment reserves a seat in a specific scheduled class or program.

Class sizes may be limited by law, TDLR requirements, curriculum requirements, instructor availability, or VFADOE policy.

Once a participant reserves a seat, that seat may become unavailable to another participant.

Payment alone does not guarantee admission, successful completion, or issuance of a certificate.

The participant must also satisfy all enrollment, identification, documentation, pre-work, attendance, conduct, technology, participation, testing, and other applicable requirements.

3. REFUND POLICY

Except where otherwise required by applicable law or expressly authorized by VFADOE, enrollment payments are non-refundable after a seat has been reserved.

No refund or credit will ordinarily be provided when the participant:

• Changes their mind;

• Finds another provider;

• Finds a cheaper or earlier course;

• Selects the wrong course;

• Fails to attend;

• Arrives late;

• Leaves early;

• Fails to complete required pre-work;

• Fails to provide required identification or documentation;

• Fails to satisfy applicable enrollment requirements;

• Experiences participant-side technology or internet problems;

• Fails to maintain required attendance;

• Fails to participate;

• Fails a required examination or assessment;

• Violates the Class Expectations;

• Engages in prohibited conduct;

• Is removed from class for failure to comply with course requirements; or

• Has enrollment terminated because of a material violation of these Terms, Class Expectations, or applicable program requirements.

Nothing in this Refund Policy eliminates any refund or other remedy that VFADOE is legally required to provide.

VFADOE may voluntarily issue a full or partial refund, credit, transfer, or other accommodation in an individual case. A discretionary accommodation does not constitute an admission of liability, waiver of these Terms, or precedent requiring VFADOE to provide the same accommodation in another case.

4. PRE-WORK AND REQUIRED DOCUMENTATION

Required pre-work is part of the enrollment process.

Depending upon the program, required documents may include identification, participant information, screening instruments, pre-tests, acknowledgments, signed forms, worksheets, Class Expectations, consent forms, or other documents required by VFADOE, TDLR, or the approved curriculum.

Participants are responsible for reading all enrollment instructions and completing all required documents by the stated deadline.

Completing only part of the pre-work does not satisfy the requirement.

Failure to open an email, read a text message, review the website, download a document, print a required form, obtain access to a printer, scan or return a document, or otherwise prepare required materials does not waive the enrollment requirements.

When an original handwritten or “wet” signature is required, an electronic signature, typed signature, electronically completed form, or other substitute will not be accepted unless VFADOE expressly authorizes it and applicable requirements permit it.

Failure to submit required documentation by the stated deadline may result in denial of admission to the scheduled class.

5. PARTICIPANT RESPONSIBILITY FOR COMMUNICATIONS

Participants are responsible for monitoring the telephone number and email address supplied during registration.

VFADOE may communicate enrollment information through email, telephone, text message, website notices, or other reasonable methods.

Participants are responsible for reviewing instructions sent to the contact information they provided.

Failure to read, open, receive, or respond to a communication does not automatically excuse failure to satisfy a previously disclosed enrollment or course requirement.

Participants are responsible for keeping their contact information current.

6. ADULT PARTICIPANTS

Participants who are 18 years of age or older are responsible for their own enrollment and compliance with program requirements.

VFADOE may communicate directly with the adult participant concerning enrollment, attendance, conduct, completion, and other program matters.

A parent, spouse, relative, friend, or other third party does not automatically have authority to make decisions for an adult participant or receive confidential participant information.

VFADOE may require appropriate written authorization before discussing protected participant information with another person, except where disclosure is otherwise permitted or required by law.

7. RESPECTFUL CONDUCT IS REQUIRED BEFORE, DURING, AND AFTER CLASS

Participants must communicate and conduct themselves respectfully and appropriately throughout their relationship with VFADOE.

This requirement begins at enrollment and applies before class begins, during class, during breaks, and after class completion.

It applies to communications and interactions by:

• Telephone;

• Text message;

• Email;

• Zoom or other videoconferencing platforms;

• Website forms;

• Social media;

• In-person communications; and

• Any other communication directed toward VFADOE, its owners, instructors, employees, contractors, representatives, or other participants.

Participants have the right to ask questions, disagree with a policy, request clarification, make a complaint, or communicate dissatisfaction. Respectful disagreement is not prohibited.

However, the following conduct may constitute a violation:

• Profanity or abusive language directed toward another person;

• Threats or intimidation;

• Harassment;

• Discriminatory or degrading remarks;

• Sexual harassment or sexually inappropriate conduct;

• Yelling, screaming, or aggressive verbal conduct;

• Repeatedly interrupting or preventing staff from communicating;

• Personal insults;

• Threatening retaliation against an instructor, employee, participant, or representative;

• Disruptive conduct that materially interferes with administration or instruction;

• Conduct reasonably creating a safety concern; or

• Other materially disrespectful or abusive behavior.

8. COMMUNICATIONS BY PARENTS, FAMILY MEMBERS, AND REPRESENTATIVES

When another individual communicates with VFADOE regarding a participant, VFADOE expects that communication to remain professional and appropriate.

Misconduct by another person will not automatically be attributed to the participant.

However, VFADOE may limit or discontinue communications with a third party who engages in abusive, threatening, harassing, repetitive, or materially disruptive conduct.

VFADOE may require future communications to be made directly by the adult participant or through a designated written communication channel.

9. RIGHT TO DENY ADMISSION OR TERMINATE ENROLLMENT FOR CAUSE

Subject to applicable law and TDLR requirements, VFADOE may deny admission, remove a participant from a class, terminate an enrollment, or decline future enrollment when there is a reasonable, documented basis to determine that the participant:

• Materially violated these Terms;

• Materially violated the signed Class Expectations;

• Engaged in prohibited conduct described in these Terms;

• Failed to satisfy required enrollment or pre-work requirements;

• Failed to satisfy attendance requirements;

• Failed to satisfy identification requirements;

• Failed to comply with required technology or participation standards;

• Appeared impaired by alcohol or drugs;

• Created a safety concern;

• Engaged in fraud, deception, or material misrepresentation;

• Materially interfered with the orderly administration or instruction of the program; or

• Otherwise became ineligible to participate under applicable law, TDLR requirements, or the approved program requirements.

Conduct occurring before the first class session may be considered when it is directly related to the participant’s enrollment or interaction with VFADOE.

A participant is not entitled to remain enrolled merely because payment has been made or paperwork has subsequently been completed after a separate material conduct violation has occurred.

VFADOE will not deny admission, terminate enrollment, or refuse future service for a reason prohibited by applicable law.

10. PROVIDER-INITIATED TERMINATION AND REFUNDS

If VFADOE terminates an enrollment because of a participant’s documented material violation of these Terms, Class Expectations, or applicable program requirements, refund eligibility will be determined under the Refund Policy, applicable law, and the circumstances of the termination.

If VFADOE cancels a class or terminates an enrollment for a reason attributable solely to VFADOE and unrelated to participant conduct, eligibility, regulatory requirements, or another provision of these Terms, VFADOE will provide the remedy required by applicable law and may offer an appropriate transfer, rescheduling option, credit, or refund.

Nothing in these Terms permits VFADOE to retain money when applicable law requires that it be refunded.

11. ATTENDANCE AND PUNCTUALITY

Full attendance is required.

Participants must attend every required instructional session and remain present for all required instructional time.

Participants must arrive on time.

VFADOE recommends logging into the virtual classroom at least 10 minutes before the scheduled start time.

A participant who arrives late may be denied admission.

A participant who returns late from a break, leaves early, repeatedly disconnects, or otherwise fails to complete required instructional time may be removed or required to re-enroll as permitted by applicable requirements.

Attendance may be verified at the beginning of class and after breaks.

12. CAMERA AND VISIBILITY REQUIREMENTS

For online instructor-led courses, participants must satisfy all applicable real-time attendance and participation requirements.

When camera visibility is required, the participant must remain visible as required throughout instruction.

Black screens, intentionally disabled cameras, positioning the camera so that the participant cannot be adequately observed, or repeatedly leaving the camera area may be treated as an attendance violation.

No filters can be used during class.

13. TECHNOLOGY REQUIREMENTS

Participants are responsible for obtaining reliable internet access and functioning equipment appropriate for participation.

Participants must have functioning audio and, when required, video capability.

Participants should test their equipment before class.

Participant-side equipment failure, insufficient internet service, loss of power, depleted batteries, device malfunction, or similar circumstances do not automatically excuse failure to satisfy attendance requirements.

14. APPROPRIATE CLASS ENVIRONMENT

Participants must attend from an appropriate stationary environment conducive to instruction.

Participants may not participate while:

• Driving or operating a vehicle;

• Shopping;

• Dining in a restaurant;

• Sitting in a drive-through;

• Working;

• Engaging in another activity that prevents full participation; or

• Remaining in an environment that materially interferes with instruction.

Participants must be appropriately dressed and positioned for participation.

Participants may not attend class while lying in bed.

The participant’s environment should be reasonably free from distractions.

15. CHILDCARE AND OTHER RESPONSIBILITIES

Participants are responsible for making appropriate arrangements for children, employment, appointments, transportation, and other responsibilities during scheduled instructional time.

The existence of another obligation does not alter required instructional hours.

16. ALCOHOL, DRUGS, SMOKING, AND IMPAIRMENT

Participants must attend sober and able to participate.

Consumption of alcoholic beverages or illegal/illicit drugs during class is prohibited.

Smoking or vaping during class is prohibited.

A participant who appears impaired or engages in prohibited activity may be removed from class.

17. TELEPHONE USE AND DISTRACTIONS

Participants may not make or receive telephone calls during instructional time except in a genuine emergency or with instructor authorization.

Texting, social media use, entertainment, gaming, or other unrelated device activity that interferes with participation is prohibited.

18. PARTICIPATION, TESTING, AND EVALUATIONS

Participants must participate as required by the approved curriculum.

Participants must complete all applicable tests, assessments, evaluations, assignments, and other required components.

Where a passing score is required, the participant must obtain the required score before successful completion can be documented.

Enrollment and attendance alone do not guarantee successful completion.

19. CERTIFICATES OF COMPLETION

A certificate will be issued only when the participant has successfully completed all applicable requirements.

VFADOE will not issue a certificate solely because a participant paid for or attended a portion of a course.

Participants are responsible for providing accurate identifying and mailing information.

The participant remains responsible for satisfying deadlines imposed by a court, probation department, DPS, employer, licensing agency, or other outside entity.

20. RESCHEDULING

Requests to change a scheduled enrollment are subject to VFADOE’s published rescheduling policy and applicable fees.

A request is not approved until VFADOE confirms the change.

Participants should not assume that a telephone call, voicemail, email, or text automatically changes an enrollment.

21. CLASS CANCELLATION OR RESCHEDULING BY VFADOE

Classes may be rescheduled when reasonably necessary because of minimum enrollment requirements, instructor availability, emergencies, regulatory requirements, technical circumstances, or other circumstances affecting lawful or appropriate delivery.

When VFADOE reschedules a class, participants will be provided an appropriate option consistent with applicable law and program requirements.

Minimum Enrollment, Same-Day & Late Registration Policy

TDLR requires a minimum of three (3) participants for an applicable court-ordered education class to be conducted. VFADOE cannot guarantee that three participants will register for, complete all required pre-class requirements for, or attend any particular scheduled class.

All scheduled classes are therefore subject to meeting the TDLR minimum enrollment requirement.

Participants who choose to register on the same day or during a late-enrollment period acknowledge that their registration does not guarantee that the scheduled class will meet the required minimum of three participants.

If the minimum enrollment requirement is not met, the class may be canceled or rescheduled. No refunds will be issued due to insufficient enrollment. The participant’s payment will be transferred as a credit toward the next available eligible class date.

Any same-day, late-enrollment, expedited, or premium enrollment fee is non-refundable and non-transferable. These additional fees apply to the administrative processing and accommodations associated with accepting an enrollment after the standard registration period and are not a guarantee that the class will be conducted.

By completing registration, the participant acknowledges and accepts that VFADOE cannot control the number of individuals who register for or ultimately attend a scheduled class.

22. NO GUARANTEE OF COURT, PROBATION, DPS, OR OTHER OUTCOME

VFADOE provides educational programs.

VFADOE does not control decisions made by courts, judges, probation officers, community supervision departments, DPS, attorneys, employers, licensing agencies, or other outside organizations.

Completion of a program does not guarantee dismissal of a case, termination of probation, restoration of driving privileges, employment action, licensing action, or any other particular legal or administrative result.

23. DEADLINES

Participants are responsible for knowing their court, probation, DPS, employment, or other completion deadline.

VFADOE is not responsible for a participant waiting until shortly before a deadline to enroll.

Participants should allow sufficient time for enrollment, completion, testing, certificate processing, mailing, and any other applicable requirements.

24. RECORDS AND DOCUMENTATION

VFADOE may create and maintain records relating to enrollment, payment, attendance, completion, communications, signed acknowledgments, incidents, and compliance with program requirements.

VFADOE may document significant incidents involving participant conduct or compliance.

Records will be maintained and disclosed in accordance with applicable law and regulatory requirements.

25. CONFIDENTIALITY AND PRIVACY

VFADOE will handle participant information in accordance with applicable confidentiality and privacy requirements.

Information may be disclosed when authorized by the participant or when permitted or required by applicable law, court order, regulatory requirement, or applicable program requirement.

26. COMPLAINTS

Participants may submit complaints or concerns to:

SUPPORT@ALCOHOLANDDRUGOFFENDERS.COM

Participants may make a good-faith complaint without retaliation.

Nothing in these Terms prevents a participant from contacting the Texas Department of Licensing and Regulation or another governmental agency regarding a matter within that agency’s jurisdiction.

27. CHARGEBACKS AND PAYMENT DISPUTES

Participants should contact VFADOE regarding billing concerns so that the matter can be reviewed.

VFADOE may respond to a payment dispute or chargeback by providing the payment processor with relevant transaction and enrollment documentation, including the applicable Terms, proof of acknowledgment, enrollment records, attendance records, communications, refund records, and other documentation reasonably necessary to respond to the dispute, subject to applicable confidentiality and privacy requirements.

Nothing in this provision limits a participant’s rights under applicable law or payment-network rules.

28. ELECTRONIC ACKNOWLEDGMENT

Electronic acceptance of these Terms is intended to constitute the participant’s acknowledgment and agreement to the extent permitted by applicable law.

VFADOE may maintain electronic records showing the date and time of acceptance and other transaction information.

Participants should retain a copy of the Terms applicable to their enrollment.

29. SEVERABILITY

If a court or other authority of competent jurisdiction determines that a provision of these Terms is invalid or unenforceable, that determination will not automatically invalidate the remaining provisions, which will remain effective to the extent permitted by law.

30. NO WAIVER

VFADOE’s decision not to enforce a provision in one instance does not constitute a permanent waiver of that provision.

Providing a refund, credit, rescheduling accommodation, exception, or other courtesy in one situation does not require VFADOE to provide the same accommodation in another situation.

31. GOVERNING REQUIREMENTS

These Terms are subject to applicable federal law, Texas law, TDLR requirements, and the requirements governing the particular court-ordered program.

If these Terms conflict with a mandatory legal or regulatory requirement, the mandatory requirement controls.

32. CHANGES TO THESE TERMS

VFADOE may revise these Terms prospectively.

The version applicable to an enrollment is ordinarily the version presented to and accepted by the participant when the enrollment transaction is completed.

VFADOE may retain archived versions of these Terms to document the provisions applicable to prior enrollments.

33. PARTICIPANT ACKNOWLEDGMENT

By checking the acceptance box, electronically signing, registering, or completing the applicable enrollment acknowledgment, the participant confirms:

I have read and understand the Virtually Fortified Alcohol & Drug Offender Education Inc. Terms & Conditions and applicable Class Expectations. I understand that payment reserves a limited class seat but does not, by itself, guarantee admission or successful completion. I understand the pre-work, attendance, conduct, technology, refund, and completion requirements. I agree to comply with these requirements.
